Welcome to Daily, a healthy food marketplace and scheduled delivery platform operated by WALL OF VOX INTERACTIVE LLP ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Daily mobile application, website, and associated services (collectively, the "Platform").
1. Introduction
1.1 Acceptance of Terms
By downloading, installing, accessing, or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and all other policies incorporated herein by reference. If you do not agree to these Terms, please refrain from using the Platform.
1.2 Eligibility
The Platform is intended for use only by persons who can form legally binding contracts under the Indian Contract Act, 1872. You must be at least 18 years of age to register an account. If you are a minor, you may use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
1.3 Definitions
- "User" or "You" refers to any person who registers on the Platform or uses the services.
- "Daily Coins" refers to promotional loyalty points issued by the Company as part of its loyalty program.
- "Wallet" refers to the in-app digital ledger used to track and store Daily Coins.
- "Order" refers to a request made by a User to purchase products listed on the Platform.
- "Delivery Partner" refers to independent third-party service providers or Company employees who perform delivery services.
- "Seller" refers to the third-party vendors or the Company (where applicable) listing products on the Platform.
2. About Daily
2.1 One Platform, Endless Healthy Choices
Daily provides a digital marketplace connecting Users with fresh produce, healthy food options, and nutritional products.
2.2 Nature of Services
Daily operates as a marketplace facilitating the sale of goods between Sellers and Users, combined with a logistics layer for scheduled deliveries and a loyalty platform powered by Daily Coins.
2.3 Healthy Food Marketplace
We curate Sellers who offer fresh produce and health-conscious food. However, Daily does not manufacture most products and acts primarily as an intermediary.
2.4 Delivery Platform
We provide logistics services to ensure your orders reach you within designated time slots.
2.5 Loyalty Platform
Users can earn and redeem Daily Coins for discounts and benefits, subject to the terms of the Loyalty Program.
3. User Accounts
3.1 Registration
To access most features, you must create an account. You agree to provide accurate, current, and complete information during registration.
3.2 OTP Verification
Registration and login are secured via One-Time Password (OTP) sent to your registered mobile number. You are responsible for maintaining the confidentiality of your mobile device and the OTP.
3.3 Account Security
You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.
3.4 User Responsibilities
You shall not use the Platform for any illegal or unauthorized purpose. You agree to comply with all local laws regarding online conduct and acceptable content.
3.5 Multiple Accounts
Users are prohibited from maintaining multiple accounts for the purpose of abusing promotional offers, referrals, or Daily Coins.
3.6 Account Suspension / Termination
We reserve the right to suspend or terminate your account without notice if we suspect any breach of these Terms, fraud, or misuse of the Platform.
4. Orders
4.1 Product Availability
All products listed are subject to availability. Fresh produce is seasonal and availability may change without prior notice.
4.2 Pricing
Prices for products are listed on the Platform and are subject to change. The price applicable at the time of order placement shall prevail.
4.3 Taxes
All applicable taxes, including GST, will be charged as per government regulations and shown at checkout.
4.4 Delivery Charges
Delivery fees may apply based on the order value, delivery distance, and selected time slot. These will be disclosed before final payment.
4.5 Order Confirmation
An order is considered "Confirmed" only after the Seller accepts the request. We reserve the right to cancel orders due to stock unavailability or logistical constraints.
4.6 Scheduled Delivery
Users may select preferred delivery time slots. While we strive to adhere to these slots, they are estimates only and not guaranteed.
4.7 Order Modification
Orders cannot be modified once they are confirmed by the Seller.
4.8 Order Cancellation
Users may cancel orders subject to the Cancellation, Refund & Replacement Policy. Cancellation fees may apply.
4.9 Order Rejection by Daily / Seller
We or our Sellers reserve the right to refuse any order for reasons including but not limited to: (i) technical errors, (ii) stock-out, (iii) delivery area restrictions, or (iv) suspicion of fraud.
5. Payments
5.1 Online Payment
We support various online payment methods including UPI, Credit/Debit Cards, and Net Banking through authorized payment gateways.
5.2 Cash on Delivery (COD)
COD may be available for select locations and order types. We reserve the right to disable COD for accounts with a high history of order rejections.
5.3 Wallet Redemption (Daily Coins)
Users may pay for a portion of their order using Daily Coins stored in their Wallet, subject to redemption limits.
5.4 Partial Payments
Orders may be paid using a combination of Daily Coins and other payment methods.
5.5 Failed Payments
In case of payment failure where money is deducted from your account, the refund will be processed by your bank/payment provider as per their timelines.
5.6 Duplicate Payments
Any duplicate payments identified will be refunded to the original source of payment within 7-10 business days.
6. Daily Coins Loyalty Program
6.1 What are Daily Coins
Daily Coins are promotional loyalty rewards granted to Users for specific actions such as purchases, referrals, or participation in campaigns.
6.2 Promotional Nature
IMPORTANT: Daily Coins are purely promotional in nature. They:
- Have no cash value.
- Are not legal tender.
- Are not electronic money or prepaid payment instruments (PPI).
- Are not cryptocurrency.
- Cannot be withdrawn, refunded, or converted into cash.
6.3 No Cash Value
Daily Coins cannot be exchanged for cash or any other currency under any circumstances.
6.4 Redemption Rules
Redemption of Daily Coins is subject to limits (e.g., max 20% of order value) as defined by the Company from time to time.
6.5 Coin Value
For the purpose of redemption on the Platform, 1 Daily Coin = [Amount, e.g., ₹1]. This value is subject to change at the Company's discretion.
6.6 Expiry
Daily Coins have an expiry period (e.g., 6 months from the date of credit). Expired coins cannot be reinstated.
6.7 Wallet Usage
The Wallet is an internal ledger for tracking Daily Coins only. It does not hold real currency.
6.8 Redemption Limits
We reserve the right to cap the number of Daily Coins that can be redeemed in a single transaction or within a specific time period.
6.9 Eligible Orders
Daily Coins may not be earnable or redeemable on certain products or during specific sale events.
7. Referral Program
7.1 Eligibility
Registered Users in good standing are eligible to participate in the Referral Program.
7.2 Referral Process
Users can invite friends using a unique referral link/code.
7.3 Reward Conditions
Rewards (Daily Coins) are credited only after the referred user completes their first successful order as per program rules.
7.4 Fraud Detection
We use sophisticated systems to detect "referral farming," self-referrals, and fake accounts.
7.5 Referral Abuse
If we detect abuse (e.g., posting codes on coupon sites, bulk messaging, using bots), we reserve the right to:
- Void all pending referral rewards.
- Suspend the User's account.
- Reverse any Daily Coins earned through abuse.
7.6 Referral Suspension
The Company reserves the right to modify or terminate the Referral Program at any time without prior notice.
8. Wallet Terms
8.1 Wallet Ownership
The Wallet is linked to your registered mobile number and is non-transferable to other platforms or individuals.
8.2 Coin Transfers
If enabled, transfers of Daily Coins are permitted only between registered Daily Platform Users and are subject to Company-defined limits.
8.3 Wallet Restrictions
The Wallet cannot be used for any purpose other than redemption against orders on the Daily Platform.
8.4 Holds
We may place a "Hold" on your Wallet balance if we suspect fraudulent activity or pending investigation into referral abuse.
8.5 Pending Transactions
Coins earned from a transaction may remain in "Pending" status until the order is successfully delivered and the return period expires.
8.6 Wallet Suspension
We may suspend Wallet access if the associated User account is flagged for violations of these Terms.
9. Delivery
9.1 Delivery Areas
Services are available only in specific geographical areas listed on the Platform.
9.2 Delivery Time
Delivery times are estimates. We are not liable for delays caused by traffic, weather, or other external factors.
9.3 Delays
In case of significant delays, we will attempt to notify you via the Platform or SMS.
9.4 Failed Deliveries
If a delivery fails due to:
- Incorrect address.
- User unavailability.
- Premises being locked.
- Refusal to accept the order.
The order may be cancelled, and a cancellation fee (up to 100% of order value for perishables) may be charged.
9.5 Customer Availability
Users must be available to receive the order during the selected time slot.
9.6 Address Accuracy
You are responsible for providing the precise location/address. Any costs arising from incorrect address input will be borne by the User.
10. Products
10.1 Fresh Produce
Fresh fruits and vegetables are natural products. Variations in size, shape, and color are normal and do not constitute a defect.
10.2 Perishable Goods
Items like milk, curd, sprouts, and fresh greens are highly perishable. These must be inspected at the time of delivery.
10.3 Product Images
Images shown on the Platform are for illustrative purposes only. The actual product may vary due to seasonal factors and supplier packaging.
10.4 Weight Variations
For products sold by weight, the final weight may vary slightly (±5-10%). Sellers aim to match the ordered weight as closely as possible.
10.5 Availability
Stock levels are updated regularly, but "Real-time" availability is not guaranteed.
11. User Responsibilities
- You agree to provide valid identification if requested during delivery (for age-restricted items, if any).
- You agree to use the products as per the storage instructions provided on the packaging.
- You agree not to harass delivery partners or support staff.
12. Prohibited Activities
Users are strictly prohibited from:
- Placing Fake Orders to disrupt services.
- Engaging in Referral Farming or creating fake accounts.
- Coupon Abuse by bypassing system limits.
- Wallet Abuse through unauthorized transfers or technical exploits.
- Reverse Engineering the Platform or its software.
- Using Automation / Bots to scrape data or place orders.
13. Intellectual Property
All content on the Platform, including logos, text, graphics, and software, is the property of the Company or its licensors and is protected by Indian and international intellectual property laws.
14. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising out of the use of the Platform. Our total liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
15. Indemnification
You agree to indemnify and hold the Company, its directors, and employees harmless from any claims, losses, or expenses arising from your breach of these Terms or violation of any law.
16. Force Majeure
We shall not be liable for any failure to perform our obligations due to events beyond our reasonable control, including acts of God, war, strikes, pandemics, or government restrictions.
17. Governing Law & Dispute Resolution
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.
- Dispute Resolution: Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in [City, State].
18. Healthy Food & Nutritional Disclaimer
- Informational Purposes Only: All nutritional information, calorie counts, and health tips provided on the Platform are for informational purposes only.
- No Medical Advice: Daily is not a medical professional. The information provided does not constitute medical or dietary advice. Consult a doctor before starting any specific diet.
- Allergy Warning: Users are responsible for checking ingredients for allergens. Daily is not liable for allergic reactions.
